in answer to my own question i just turned off tidy in tinymce not sure i need it, unless client pastes from word.
Where did you go to turn it off?
nm, found it:

Hi,
I'm using v4.5.2 and unfortantely the steps to disable Tidy in the links above do not help in me get rid of the [Tidy Error] I'm experiencing in IE9. Neither does the solution mentioned in this post: http://our.umbraco.org/forum/ourumb-dev-forum/bugs/13785-IE9-[tidy-error]?p=1
Does anybody have any other suggestions about how to solve this issue?
Thanks a lot inadvance.
Cheers,
Kim
